E type der-tight in 1 loose in 3?sj

Im putting together a winter bike for mud. I noticed the front der when its shifted all the way down it's fairly tight but when i shift it to 3 (all the way up) it has a lot of slop in it. Should i replace it? I dont have a chain on it yet, but best i can recall before i tore it down last year it was shifting fine. I hate to put the chain on then have to break it again due to a bad der. thx
