New Marzocchi Dj3 2003 stanchion coat chips... wtf?Guim

first, i paid 329$ cdn for my Dirtjumper 3(new). it was a great deal, but with great deals often comes a badluck.
First, the fork didn`t have enough oil in it (20mm less than the minimum!), then the stanchion coating chips. it`s like if there was a little rock in the seals or bushings. It`s only chipping on one side of the fork. When I compress the fork, I have the sensation like something is rubbing somewhere in the leg. It doesn`t more freely. I only have the fork since last week and I rode one time on the road. i`ve never had a problem with my other marzocchi, but now i get a new and it has problems.

Anybody had the same situation? would it be warrantied? Thanks for any answer!
